1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of discovercybersolutions.com (the "Site") and any related content, tools, assessments, downloads, and services offered by Cyber Solutions Inc. ("Cyber Solutions", "we", "us", "our"). By accessing or using the Site you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Site.

3. Use of the Site

• You may use the Site only for lawful purposes and in compliance with these Terms and applicable law.
• You will not interfere with the Site's operation, attempt unauthorized access, probe for vulnerabilities, scrape at volumes that burden our infrastructure, or use the Site to transmit malware or unlawful content.
• You are responsible for any content you submit through forms, assessments, or other inputs and represent that you have the right to share it.

4. Accounts

Some features (such as administrative tools or client portals) require an account. You agree to provide accurate information, maintain the confidentiality of your credentials, enable multi-factor authentication where offered, and notify us promptly of any suspected unauthorized access. You are responsible for activity under your account.

5. Services agreement

Managed IT, cybersecurity, compliance, incident response, AI, and voice services are governed by a separate written agreement (Master Services Agreement, Statement of Work, or equivalent) executed with the client. These Terms govern Site use only. Where these Terms conflict with a signed services agreement, the services agreement controls for the services it covers.

6. Intellectual property

The Site and all content - including text, graphics, logos, icons, software, design, and the underlying code - are owned by or licensed to Cyber Solutions and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the content for personal or internal business evaluation purposes. All rights not expressly granted are reserved.

7. Trademarks

"Cyber Solutions" and our logos are trademarks of Cyber Solutions Inc. Microsoft, Azure, and ThreatLocker are trademarks of their respective owners; references are nominative and do not imply endorsement.

8. User submissions and feedback

If you submit ideas, feedback, suggestions, or materials through forms or assessments, you grant Cyber Solutions a non-exclusive, royalty-free, worldwide, perpetual license to use them to operate, improve, and promote our Services, without obligation to you.

9. Assessments and tools

Interactive assessments, scorecards, calculators, and downloadable content on the Site are provided for general informational purposes only. They are not professional, legal, or compliance advice. Results are estimates based on the information you provide and should not be relied on as a substitute for an engagement with qualified professionals.

10. Third-party links and content

The Site may link to third-party websites or display third-party content. We do not control and are not responsible for their availability, accuracy, content, or practices. Your interactions with third parties are at your own risk and subject to their terms.

11. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. NOTHING ON THE SITE CREATES A SERVICES OR CONFIDENTIALITY OBLIGATION OUTSIDE A SEPARATE WRITTEN AGREEMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBER SOLUTIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless Cyber Solutions from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your content, or your breach of these Terms or applicable law.

14. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which describe how we collect, use, and protect personal information and the rights available to you under GDPR, CCPA/CPRA, and other applicable laws.

15. Termination

We may suspend or terminate access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

16. Export and sanctions

You may not use the Site in violation of US export controls or sanctions, or if you are located in or ordinarily resident in a sanctioned country or are on a US restricted-party list.

17. Governing law and venue

These Terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-laws principles. Subject to Section 18, the state and federal courts located in Anderson County, South Carolina have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction there.

18. Dispute resolution

We prefer to resolve disputes informally. Before filing a claim, send a written notice describing the dispute to legal@discovercybersolutions.com and allow us 60 days to respond. Any unresolved dispute will be resolved exclusively as set forth in Section 17. You and Cyber Solutions waive the right to a jury trial to the extent permitted by law.

19. Changes to the Terms

We may revise these Terms from time to time. Material changes will be communicated through the Site. Continued use of the Site after a revision constitutes acceptance.

20. Miscellaneous

These Terms together with the Privacy Policy and any applicable services agreement constitute the entire agreement between you and Cyber Solutions regarding the Site. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
